Appeal and Review
Chapter-IX of the
Afghanistan Procurement Law provides for a mechanism for an expert
and independent administrative review in respect of Applications for
Review brought by the bidders for alleged breaches of the provisions
of the Law. For the purposes of conducting administrative review of
the Applications for Review, and related appeals, the PPU shall
establish an Administrative Review Committee composed of experts.
Prior to the
entry into force of a procurement contract, the bidder may submit an
application for review of the related procurement proceeding to the
procuring entity. The decision of, or the failure to decide within
the required time by the procuring entity may be appealed to the
Administrative Review Committee, established by the PPU. Also,
subsequent to the entry into force of a procurement contract, the
bidder shall submit the Application for Review of the related
procurement proceeding to the Administrative Review Committee.
Pursuant to
article 106 of the Law, for the purpose of establishing detailed
rules and procedures to fulfill the objectives and to implement the
provisions of Chapter-IX of the Law, the PPU has approved and
adopted the “Manual of Procedures for Procurement Appeal and
Review”. The Manual provides for procedures to support and
administer the operations of the Administrative Review Committee and
the Review Board established pursuant to provisions of Chapter-IX of
the Law. The Manual is effective from March 18, 2007.
